From Ozzy's Facebook and Myspace:

Below is my official press statement on the official Black Sabbath trademark lawsuit. I am very saddened that I’ve had to take legal action against Tony. This is something that I’ve tried to avoid for years. I am not Geezer or Bill’s voice. However, till the day I die I will not change my mind on this issue. The Black Sabbath trademark should be equally owned by Geezer, Bill, Tony and I as the true Black Sabbath lineup is Tony, Geezer, Bill and I. We’ve all been mates since school. I’ve always said there is an invisible thread that holds us together. Tony, lets get this ridiculous issue sorted and move on with our lives. You’re 61, I’m 60. I hope that we’ve got a good 20 years left in us. But if not, God Forbid something happens to you. What’s going to happen to the Black Sabbath trademark? Who’s going to oversee it? Don’t you think after we’re long gone the rights should stay in your family, my family, Bill’s family and Geezer’s family?

Statement from OZZY OSBOURNE:

“It is with great regret that I had to resort to legal action against my long term partner, Tony Iommi, but after three years of trying to resolve this issue amicably, I feel I have no other recourse. As of the mid-1990’s, after constant and numerous changes in band members, the brand of "Black Sabbath" was literally in the toilet and Tony Iommi (touring under the name Black Sabbath) was reduced to performing in clubs. Since 1997 when Geezer, Bill and myself rejoined the band, Black Sabbath has returned to its former glory as we headlined sold-out arenas and amphitheatres playing to upwards of 50,000 people at each show around the world. We worked collectively to restore credibility and bring dignity back to the name “Black Sabbath” which lead to the band being inducted into the UK and US Rock & Roll Hall of Fames in 2005 and 2006, respectively. Throughout the last 12 years, it was my management representatives who oversaw the marketing and quality control of the “Black Sabbath” brand through OZZFEST, touring, merchandising and album reissues. The name "Black Sabbath" now has a worldwide prestige and merchandising value that it would not have had by continuing on the road it was on prior to the 1997 reunion tour. Tony, I am so sorry it’s had to get to this point by me having to take this action against you. I don’t have the right to speak for Geezer and Bill, but I feel that morally and ethically the trademark should be owned by the four of us equally. I hope that by me taking this first step that it will ultimately end up that way. We’ve all worked too hard and long in our careers to allow you to sell merchandise that features all our faces, old Black Sabbath album covers and band logos, and then you tell us that you own the copyright. We’re all in our 60’s now. The Black Sabbath legacy should live on long after we have all gone. Please do the right thing.”

I'm lost for words. I can't believe Ozzy (read: Sharon) would have the audacity to tell anyone to "do the right thing" after all they've done to the Sabbath name.

This is absolutely absurd. Ozzy signed away all rights to the name in 1980 after he was fired, Geezer and Bill signed away their rights to the name in 1985. Tony Iommi has been the only original member to keep the name alive and has been the principal song-writer from day one.

Funny how this all comes about as soon as Iommi filed a lawsuit against Live Nation, who have been selling Black Sabbath/Iommi-related merch despite their contract running out in 2007.

The other thing that annoys me about this whole thing is that Ozzy says that all the band members should get equal rights to the name - then why are you trying to get 50%, Ozzy? "Do the math", as the Americans would say. 100% divided by 4 is 25%, so why should you get more than anyone else? Especially since you barely wrote anything during your ten-year tenure with the band.

Also, don't drag Geezer and Bill into this, you coward. You don't deserve any sympathy.

Ozzy's said that the band's popularity plummeted since he left the band - not true. Just look at the Billboard charts. Sabbath were dying from 1975 - 1979. When Dio came onto the scene, Sabbath were rejuvenated and more popular than ever. So technically Dio has more of a claim, as it was only post-1983 that the decline in popularity happened.

Ozzy has completely killed Black Sabbath with this - he was doing a good job of it between 2001 and 2005 anyway but giving sub-par performances and, even worse, cancelling shows due to the fact he can't sing. And he has the cheek to say that the reunion has only done Sabbath good! I'm sorry, twelve years of shortened sets and no new material (save two mediocre tracks on Reunion) compared to what Sabbath were doing without him... at least they were putting out albums every year or two, even if they were playing clubs. I'd rather they were creatively active than a mere nostalgia act.

IOMMI = SABBATH

Fri 15 May – Electric Wizard

After much trial and tribulation I arrived at the venue just in time for the doors opening. The venue was small, perhaps 500 capacity, but with very good acoustics.

I watched a bit of The Freezing Fog, who sounded better than they looked. When they appeared on stage with short, almost trendy hair, some with glasses and all with checked shirts... they looked like a screamo band. But no, I was pleasantly surprised to hear some actual singing and good old-fashioned rocking out. They weren't anything special or new, but enjoyable enough.

Next came Xela. What a contrast! I actually really like noise bands, but this was just... well, shit. Maybe it was the PA system, but this one-man-and-a-Mac was furiously fiddling with knobs and sliders... what came across was static and low rumbling. Maybe that was the point? I don't know, I just didn't enjoy it. I don't think many other people did, either, considering the abuse he got as he left the stage.

Electric Wizard came on to raptuous cheering at about ten minutes to 10 and set up their gear. Jus got a huge cheer and actually gave the horns to everyone, with a big grin on his face. Bang on 10pm, they started and played the following songs:

Witchcult Today
Satanic Rites of Drugula
Return Trip

Then there was a 15-minute break as Jus' amp gave up the ghost. There was a lot of faffing around, but eventually they got it working again and the set continued:

The Chosen Few
Funeralopolis

Encore:
We Hate You

Overall a very enjoyable and heavy show. I began by standing quite close to the front, but then moved further back to get a better sound. Since it was such a small venue it still felt quite intimate, even though I was far from the stage.

Briefly bumped into xcherrybombx outside. =D

Only one of my pictures was good enough to post, but what a picture it is. =3
A fantastic night! I didn't catch much of The Acorn, so I won't write anything about them. I couldn't take them seriously anyway as they have the same name as a local seedy Witherspoons.

It turned out to be Guy Garvey's birthday, and as the group huddled around the keyboard to begin Weather To Fly, He was serenaded by the band, the backing singers and the members of The Acorn as a cake was brought on stage.
A nice mix of old and new, although I felt the encore was a little too mellow. I was also slightly disappointed by the way Any Day Now came across; it could've just been the sound, as the backing vocals were practically non-existant, and I was at the sound desk. Without the backing vocals, the "Any day now, how's about getting out of this place, anyway?" line doesn't really have as much effect. Also Guy screwed up the lead guitar line in it just once... but it was horrendous to my ears. Other than that, I can't fault anything. My favourite gig of 2009 so far, if not better than everything of 2008, too.

I even cried during Loneliness of a Tower Crane Driver at the "Send up a prayer in my name, just the same, they say I'm on top of my game" as it was so powerful.

Sat 13 Dec – Electric Wizard, Grand Magus, Moss, Taint, Litmus, Serpentcult, Gentleman's Pistols, Diagonal (UK), Witchsorrow

What a fantastic day!

My friend and I travelled to London the day before the gig and stayed at a hostel. I had an ulterior motive for going to the gig, and that was to whore my band (Triangle Theory) to anyone who would listen, and hopefully Lee Dorrian. =D

Anyway, at about 2pm I headed to the venue to see if anyone was milling about. I saw Seb, drummer from Grand Magus, outside the Tavistock Hotel, and he recognized me from various other meetings. We spoke for a bit, and I told him how close the venue was. After hanging around the venue for a few minutes, the rest of Grand Magus appeared, recognized me as the crazy Scottish guy from Edinburgh, and asked me which door to get in the venue. I showed them, and Fox knocked on the door. I asked if JB could get me on the guest list, but the guy who opened the door said no. =(

I went back to the hostel to get my friend, then we walked back to the venue, by which time it was 3pm. There was a queue practically half way around the building. We heard Witchsorrow start, and by the time we'd actually got into the venue, they'd finished. So we decided to go to the merch stall, and after twenty-five minutes I got an Electric Wizard t-shirt, and the limited edition 12" vinyl zomgexclusive.

Serpentcult had already started by this time, and I had no intention of pushing to the front with vinyl under my arm. The sound was a bit muddy I thought; the drums were too loud, and there wasn't a lot of distinction between the bass and guitar.

Afterwards, the band came to the merchandise stall, so I spoke to them for a while. They remembered me from the Edinburgh gig last month, and Michelle (singer) asked if I had the CD I'd promised her. I did. =P I got some pictures with the band, and bumped into some people I knew.

I also bumped into Ben Ward from Orange Goblin!

"I feel like a fuckin' celebrity!"

Next up were Litmus, who I really don't like, so I used this opportunity to seek out Lee Dorrian and anyone else who might be eligible for a Triangle Theory CD.

Moss came on, and although I don't really like them on record, live they were a bit better. Although they looked bored as hell. The sound was better by this point, and I was surprised to see the guitarist using an Ibanez... and they had no bassist!

Diagonal (UK) were next, and were somewhat a contrast to Moss! They've got a very King Crimson-influenced sound, but with two keyboard players and a saxophonist. I quite enjoyed them, although whenever one of them sang, I cringed they were that bad.

It was at this point I spotted Lee Dorrian standing speaking to someone, very inconspicuously at a door near the merch stall. I approached him, asking for him to sign my ticket and my Teeth of Lions Rule the Divine album, adding that I'd already had my Cathedral albums signed. He was genuinely gracious and seemed happy someone recognized him. I asked for a photo, and he obliged, then asked if he'd like to check out my band's CD. =P I'm a cheeky bastard, I know. He said he'd be happy to. =D

Gentleman's Pistols blasted onto the stage, and Lee said he wanted to see these guys, so we shook hands and parted ways. God they were cheesy. Every song sounded the same, but they were enjoyable enough. If their set had been any longer, though, I may have wandered off elsewhere.

Having successfully tracked down the owner of Rise Above Records, I decided to let my inhibitions go, give my vinyl and bag to my friend, and go to the front and enjoy the remainder of the evening. And what a remainder it was! Taint were really good; much better than when I last saw them, supporting Clutch. The new song they played was awesome.

Grand Magus were next, and I was a bit disappointed. They were quite sloppy, and their sets are getting predictable. Fox's bass sounded far too distorted, and completely drowned out JB. Some cunts (possibly from Leeds or thereabouts) kept heckling them with shouts of "Who knows? The shadow knows!" At first it was amusing, but every thirty seconds for about ten minutes gets really tedious. After they'd played, Fox came back onto the stage to start gathering his equipment. He saw me and instantly came over to shake my hand. *headasplodes*

Everyone eagerly anticipated the next band... Electric Wizard! They were introduced by a druid - possibly Lee Dorrian, I couldn't really see since I was directly underneath him - and they began with Witchcult Today.

Man, it was so slow and heavy. Seriously, I have never heard anything as heavy as these guys (and gal), and I've seen Sunn O)))! They also played Satanic Rites of Drugula, Return Trip, a droney jam, The Chosen Few, and ended on a crushingly slow Funeralopolis. I was pleasantly surprised, as I'd heard that live they weren't that great, or were at least hit-or-miss. They were awesome, and easily one of my favourites of this year.

I've read since that people are moaning about how few songs Wizard played. To them I say, stop your whining. Of course they were only going to get an hour, considering how many other bands there were, plus the fact their songs are so long meant we'd only get a few. And you should be grateful they played at all! They've probably only played as many gigs as Triangle Theory. =P

1. How did you get into 29? (Rush)

When I was about 15 I had the tendency to buy my dad CD versions of the vinyl he had. I bought All the World's a Stage and loved it, and have since bought many more of their albums.

2. What was the first song you ever heard by 22? (The Abominable Iron Sloth)

Hats Made Of Veal And That New Car Scent. The song title intrigued me, and, admittedly, I hated it on first listen. Then I got into the groove, and finally accepted the vocals as being fucking pissed off. It all fit together.

3. What’s your favourite lyric by 33? (Metallica)

I've never really thought much of Metallica's lyrics. The first ones that spring to mind are "I was born for dying" from Disposable Heroes.

4. What is your favourite album by 49? (Glenn Hughes)

Soulfully Live in the City of Angels.

5. How many albums by 13 do you own? (Goatsnake)

Just the one, although they only had two and one EP, all of which except their first album are out-of-print.

6. What is your favourite song by 50? (The Beatles)

I Am the Walrus. I don't particularly like The Beatles, but I do try.

7. Is there a song by 39 that makes you sad? (Anaal Nathrakh)

Err... they aren't known for their ballads.

8. What is your favourite album by 15? (Sasquatch)

Self-titled. The second one was quite shit, unfortunately.

Wed 5 Nov – Goldfrapp

After being thrown around a diversion in Edinburgh's West End, I eventually stumbled upon the Corn Exchange. Quite an odd vibe for a venue of that size, but once it filled up with people and the lights were down it was very nice and intimate.

The support act was a very bland folk-singer-songwriter who didn't introduce himself until heckled by an audience member. He said he was called Pete Greenwood, from Leeds, and arrived on-stage at 8pm. He used some very odd tunings on that acoustic guitar of his; just a pity he did his tuning audibly and not with a tuner. Pretty much every song had the same rhythm and feel to them, and he used far too many suspension chords for my liking.

After his half-hour set and another twenty minutes of getting the show ready for Goldfrapp, the audience were treated to an announcement regarding audio and visual recording equipment. The lights dimmed, a big black screen dropped to reveal the backdrop to the stage... and then nothing happened. Everyone expected the band to come on, but we waited another ten minutes or so.

Finally on came the band, all dressed in white and looking very druid-esque, standing in front of a kind of thatched background with bunting draped across it. Ms Goldfrapp herself appeared with her wild, curly blonde hair thrown into a crazy fireball, and what looked like pink pyjamas with wings.

The set was nice and balanced in that there were plenty of sombre and dark songs from Felt Mountain and Black Cherry, but just enough dance-orientated material from Supernature to keep the pop fans entertained. Obviously Seventh Tree songs were in the set, but, thankfully, there weren't too many.

Paper Bag
A&E
Eat Yourself
Little Bird
Number 1
Happiness
Ooh La La
Caravan Girl
Train

Encore:
Strict Machine

I'm sure there was another song from Supernature but I can't remember what it's called. We were meant to get Clowns, and another song, possibly from the new album, but I think Alison's in-ear monitor was playing up and she couldn't hear her cue, so they gave up and moved swiftly onto another song.

The band were tight as anything, and they all seemed to be enjoying themselves. Alison was very much like Kate Bush in her movements, and as such entertaining and commanding to watch. The band consisted of a keyboardist/keytarist/backing singer, a harpist/secondary keyboardist/backing singer, guitarist/backing singer, guitarist/keytarist/electric violinist/recorder player/backing vocalist, bassist and drummer.

Overall an entertaining evening and an interesting one if you're sad like me and like looking at instruments and technical stuff.

Wed 29 Oct – Grand Magus, Serpentcult, Flat Iron

When I arrived outside the venue, JB, Fox and Seb of Grand Magus were taking their gear out of the van, so I asked them for autographs. Got them to sign Monument and Iron Will on vinyl. JB said I was a real man for being outside in the harsh Scottish weather in a t-shirt and jeans, while he had a big leather jacket on and a hoodie.

Inside I caught the very end of Battle of the War Machines, featuring the guitarist from one of my old bands. Can't really say anything, as by "very end" I mean the last two notes of Creeping Death.

Flat Iron were the next band, and they had some nice groovy riffs, coupled with raw, Phil Anselmo-esque vocals. The best thing about them, though, was the faces the drummer pulled. He looked like he was doing a shit.

Serpentcult, from Belgium, were next up. Started off with some really heavy riffage, almost drone-like. Then in came the groove, and the high-pitched wailing of their female singer. I was right at the front with three other people (who kept looking at me oddly), so I got the sound of the band really well. I know they played The Harvest, Serpentcult, Weight of Light, Screams From the Deep and New World Order. I think there were a couple of others in there. Anyway, they were really fucking heavy and slow, so I enjoyed them.

On came MAGUS!! I'd have enjoyed the show a lot more if it weren't for my mate (guitarist in the first band) hanging onto me for support (one shot too many) and constantly checking for my approval. Here's the setlist:

Like The Oar Strikes The Water
Blood Oath
Nine
Lodbrok
Iron Will
Ulvaskall (Vargr)
Wolf's Return
The Shadow Knows
Baptized in Fire
Kingslayer

The songs were a bit quick, and we didn't get an encore. JB sounded great, vocally and on guitar, although the bass was a bit loud. Seb seemed to be a bit disinterested if I'm honest.

As much as I was pissed off at my mate for being such an annoying bastard all through Magus' set, he made up for it by letting me backstage to hang with the bands. I've met Magus before, so I left my drunken idiot of a friend to talk to (read: bore the hell out of) them, while I spoke to Serpentcult. We spoke of Sunn O))) and Goatsnake, Pantera and Black Sabbath, and, for some reason, Sade and Tears for Fears.

All in all, a good night. Fired me up to see them both again in London in December!

Sun 14 Sep – Pelican, Torche

Hadn't really heard Torche before. They were fairly average with occasional moments of doomy brilliance.

This was my third time seeing Pelican at the Oran Mor in Glasgow, and although their set was particularly awesome this time around, it seemed quite short. Indeed, an apparent curfew meant they had to drop their encore, Last Day of Winter, entirely.

Setlist (not too sure of the order; might have even missed a song out):

Lost In The Headlights
Dead Between The Walls
New Song 1
March to the Sea
City Of Echoes
New Song 2 (with Bryan and Trevor swapping instruments)
Sirius
The Woods

Not sure if there was a song between the first two I have there. Awesome to hear The Woods being played; it was epic as fuck.

The two new songs are heavy, kind of a mix between Bliss In Concrete and March to the Sea. I have high hopes for the new album being a return to their doom roots. =D

I hung around afterwards as I usually do and got the guys to sign my Pelican EP vinyl. They all recognized me from the last two times I've waited for them, and Laurent even said he was glad I did, because no matter how shitty they thought they play in Glasgow, I'm always there for them to talk to. XD I spoke to Larry for ages about KTL, Khanate and Khlyst, which was cool. They all complained about the sound on stage at the venue, but I assured them it sounded awesome where the audience were. They said when they come back they hope to play at the ABC2 instead. I pushed for them to play in Edinburgh. =)
